FCC Sets Guidelines for 700MHz Spectrum Auction

After months of speculation and interest, the Federal Communications Commission (FCC) recently set the guidelines for the auction of the 700 MHz wireless spectrum.

This spectrum is currently occupied by television broadcasters in TV Channels 52-69 and these stations are required to go digital as a result of the digital television ("DTV") transition in 2009 and therefore it is now being made available for wireless services, including public safety and commercial.

In light of the developments that have occurred over the past several years in the market for commercial wireless communications and the evolving needs of the public safety community for advanced broadband communications, the Commission began reexamining its rules governing the 700 MHz Band in 2006.

The rules require that the winners of this band allow any wireless devices to connect to the network, access to any content and also prohibited the winner from blocking or slowing wireless and Web content from competitors. The conditions for the auction taking place early next year have been the focus of intense debate in recent months. Advocacy groups and companies have called for open-access rules, which require the winner to provide access to competitors, a move that could alter the wireless landscape.

Updated Guidance Document on Laser Products Issued

The U.S. Food and Drug Administration (FDA) has released an updated version of its "Guidance on Laser Products" that may offer compliance relief to some manufacturers.

The Guidance document is an effort to clarify for manufacturers of laser products how to meet the FDA's requirements, which are based on Edition 1.2 of IEC 60825-1 issued in August 2001, while also addressing differing criteria found in IEC 60825-1, Edition 2, which was released earlier this year. Although the FDA intends to amend its current requirements to ensure greater consistency with the provisions of Edition 2 of the standard and to ease the compliance process, it has not yet done so; hence the need for guidance from the agency.

In essence, the Guidance document identifies those areas where the FDA will allow manufacturers to demonstrate compliance with either version of the standard, as well as those areas of the present FDA regulations that will remain unchanged.
