FCC Makes DFS Requirements Official

The FCC recently issued a Memorandum Opinion and Order (MO&O), responding to requests for clarification or reconsideration of the new rules for Unlicensed National Information Infrastructure (U-NII) devices in the 5.25-5.35 GHz and 5.47-5.725 GHz bands, including Wireless Local Area Networks (WLANs), which were adopted in their recent Report and Order on this subject. Specifically, the FCC is granting a request by the Wi-Fi Alliance to clarify the Transmit Power Control (TPC) requirements in section 15.407(h)(1), but dismissing a request by the Wi-Fi Alliance to clarify the channel availability check time requirement in section 15.407(h)(2)(ii).

The FCC is also denying a request by Globespan Virata to revise the rules to state that U-NII devices are not required to detect and avoid frequency hopping radar signals, and also dismissing a request by Extreme Networks Inc. to modify the definition of a U-NII central controller that must include Dynamic Frequency Selection (DFS) capability. The FCC also issued a revised measurement procedure for certifying U-NII devices for compliance with the DFS requirements in these bands. The FCC says that these actions are intended to ensure that all applications for equipment certification of U-NII devices filed on or after July 20, 2006 will comply with all U-NII requirements for these bands. In essence, this makes the DFS requirements official for new products effective immediately and will become a formal requirement for products already on the market by July 2007.

Lighting Manufacturer to Pay $700k for Hazardous Lights

The U.S. Consumer Product Safety Commission (CPSC) has reached an agreement with Acuity Brands, Inc. of Atlanta, GA, under which the company will pay a $700,000 civil penalty for failing to report defects and hazards associated with more than 1.4 million of its Lithonia Lighting products.

The CPSC conducted four separate investigations into the timing of Acuity's notification to the agency of defects with its lighting products. The company allegedly received hundreds of reports of product failures, including fire and smoke hazards, cracked and/or falling reflector lenses, defective cords, and at least two reports of injuries. However, in each instance, the company redesigned and/or replaced the defective lighting fixtures prior to notifying the CPSC of the product defects.

Federal law requires manufacturers, retailers and distributors to report to the CPCS immediately upon receipt of any information that would support the conclusion that a product contains a defect which presents a substantial or unreasonable risk of injury or death to consumers. However, in agreeing to settle the matter with the CPCS, Acuity did not admit the CPSC's allegations and denied that it violated any law.
